Abstract

S’il est communément admis que le droit exerce une influence sur le domaine musical – notamment à travers les lois relatives à la propriété littéraire et artistique et le rôle des institutions culturelles – il convient de ne pas oublier l’influence des artistes sur l’évolution du droit. Le rapport entre artistes, lois et institutions est en effet construit autour de jeux d’influences réciproques. Nous aborderons ces jeux d’influences en mettant en exergue la contribution des lois et des institutions à l’essor artistique à travers l’encouragement de la création musicale et la préservation du patrimoine musical avant de nous pencher sur la question de l’influence des artistes sur le développement des lois et des institutions en soulignant l’action des musiciens et des musico-logues en Tunisie avant et après l’indépendance. 

If it is commonly accepted that the law influences the musical field – especial-ly through laws relating to literary and artistic property and the role of cultural institutions – it is important not to forget the influence of artists on the evolu-tion of the law. The relationship between artists, laws and institutions is indeed built around reciprocal influences. We shall approach these influence games by highlighting the contributions of laws and institutions to the artistic development through the encouragement of musical creation and the conser-vation of the musical heritage before addressing the issue of influence of the artists on the development of laws and institutions by highlighting the action of musicians and musicologists in Tunisia before and after the independence.
